The Lagos State Law Reform Commission has identified the need to review certain provisions of the existing Lagos State Tenancy Law of 2011 according to a press released published by Lagos State. The review will be done with a view to ensure fairness and to reposition the law to reflect present societal values and realities.

The resolutions to be inserted in the proposed bill will be presented by the Law Reform Commission upon review of the law. The Chairman of the Lagos Law Reforms Commission, Prof. Gbolahan Elias has disclosed that the proposed review will focus on the role of Estate Surveyors and Valuers, legal practitioners and the judiciary in tenancy matters.

Speaking at the stakeholder’s meeting on the Tenancy Law of Lagos State, the State Attorney-General and Commissioner for Justice, Adeniji Kazeem noted that feelers from members of the public reveal that the citizens are not pleased with the present state of the law, hence the review needs to and will most likely:

  • Consider the introduction of rules of procedure to help fast-track proceedings for recovery of possession;
  • Propose time limits for the disposal of tenancy matters;
  • Address failures to adhere to the section of the law on advance payment that makes it unlawful for a landlord to receive more than a year’s rent in advance;
  • and iron out other grey areas contained in the law.
